# User Responsibilities

Users agree to use **VyaparChat Pro** only for lawful, ethical, and legitimate business purposes. Users must comply with all applicable laws, regulations, and the policies governing the WhatsApp Business Platform, including those published by Meta.
Users shall not use the Platform for activities including, but not limited to:
* Sending spam, unsolicited, or bulk messages without appropriate consent.
* Fraudulent, deceptive, misleading, or unlawful marketing practices.
* Distributing malicious software, phishing content, or harmful materials.
* Promoting illegal products, services, or activities.
* Infringing upon the intellectual property or privacy rights of any third party.
VyaparChat Pro reserves the right to suspend or terminate access to the Platform if any activity is determined to violate applicable laws, Meta's policies, or these Terms.

## 2. Account Security
Users are solely responsible for maintaining the confidentiality and security of their account credentials, API keys, authentication tokens, and associated devices.
Users must:
* Use strong and secure passwords.
* Prevent unauthorized access to their account.
* Immediately notify VyaparChat Pro of any suspected or actual unauthorized access, security breach, or compromise.
VyaparChat Pro shall not be liable for any loss, damage, or unauthorized activity resulting from the user's failure to adequately protect their account credentials.

## 3. Payments and Billing
Users agree to pay all applicable subscription fees, service charges, messaging fees, taxes, and other applicable charges in accordance with the selected pricing plan.
Failure to make timely payment may result in:
* Temporary suspension of services.
* Restriction of account functionality.
* Permanent termination of the account after reasonable notice, where applicable.
All fees paid are subject to the applicable Refund Policy and are non-refundable unless expressly stated otherwise.

## 4. Data Protection and Customer Consent
Users acknowledge that they act as the Data Controller for any customer or end-user information processed through the Platform.
Users are solely responsible for:
* Obtaining all legally required consents before sending WhatsApp messages.
* Maintaining records of user consent where required by law.
* Complying with all applicable data protection and privacy laws, including those relating to electronic communications and personal data.
* Ensuring that all customer information uploaded or processed through the Platform has been collected lawfully.
VyaparChat Pro acts only as a technology service provider and shall not be responsible for the legality, accuracy, or validity of user-collected data or messaging practices.

## 5. Compliance with Meta Policies
Users must continuously comply with all applicable Meta policies, including the WhatsApp Business Messaging Policy, Commerce Policy, Business Terms, and any future updates issued by Meta.
Any action by Meta, including but not limited to:
* Phone number quality reduction,
* Messaging restrictions,
* Account review,
* Rate limiting,
* Suspension,
* Permanent disablement of a WhatsApp Business Account,
resulting from the user's content, messaging practices, policy violations, or business operations shall remain the sole responsibility of the user.
VyaparChat Pro shall not be liable for any penalties, restrictions, revenue loss, business interruption, or damages arising from actions taken by Meta against the user's account.

## 6. Indemnification
Users agree to indemnify, defend, and hold harmless VyaparChat Pro, its owners, employees, affiliates, partners, and service providers from any claims, liabilities, losses, damages, legal proceedings, penalties, costs, or expenses (including reasonable legal fees) arising from:
* Violation of these Terms;
* Breach of applicable laws or regulations;
* Violation of Meta's policies;
* Unauthorized or unlawful use of the Platform;
* Infringement of third-party rights;
* Customer complaints arising from the user's messaging activities.

## 7. Right to Suspend or Terminate Services
VyaparChat Pro reserves the absolute right to suspend, restrict, or terminate access to the Platform, with or without prior notice, if it reasonably believes that a user has:
* Violated these Terms;
* Violated Meta's policies;
* Engaged in fraudulent, abusive, or illegal activities;
* Created security or operational risks for the Platform or its users;
* Failed to pay applicable fees.
Such suspension or termination shall not relieve the user of any outstanding payment obligations or liabilities incurred prior to termination.
